User agreement between the user (User, you) and Opodo Limited (Opodo,
we). Please read these terms and conditions of use (Terms and Conditions)
before using Opodo's website (Site).
The Site
The Site is offered to you by Opodo Limited, whose registered office
is at 5 Chancery Lane, Clifford's Inn, London EC4A 1BU, Great Britain.
Please note that all correspondence regarding customer service should
be sent to Opodo, PO Box 6589, Leicester, LE1 3ZZ.
Acceptance of Terms and Conditions
You consent to the Terms and Conditions when you use the Site, without
qualification. If you disagree with any part of the Terms and Conditions,
you may not use the Site in any way.
Opodo's Services
Opodo offers an online travel portal that allows you to research
and check for availability of travel products and services to suit
you and enables you to make bookings with suppliers.
You can choose from a variety of services on the Site. Opodo offers
you the power to book flights and hotel rooms, rental cars through
its partners Holiday Autos Limited and Hertz Europe Limited, package
holidays through its partner Holiday Express Limited, city breaks through
Cresta Holidays Limited, specialist holidays through Bluebell Networks
Limited, airport parking and related services through BCP Limited -
and even purchase travel insurance directly via the Site. We also display
general information about travel, including destination guides.
Opodo Acts as Agent only
Opodo acts as agent for third party suppliers such as airlines, hotels,
insurance companies, holiday suppliers and others (Travel Supplier).
When you make a booking via the Site, and your preferred travel product
or service is available, the contract will be between the Travel Supplier
and you. Opodo is not a party to the contractual relationship. The
Travel Supplier (other than airlines and insurance providers) is responsible
for issuing tickets and other travel documents. In relation to car
rental your relationship will be with either Holiday Autos Limited
or Hertz Europe Limited. The air holidays advertised on the Site are
provided through Holiday Express (UK) Ltd, an ABTA travel agency (membership
number E8585) and who act on behalf of ATOL holding tour operators.
The specialist holidays advertised on the Site are provided through
Bluebell Networks Limited who act on behalf of ATOL licensed tour operators.
The city breaks advertised on the Site are provided by Cresta Holidays
Limited, an ABTA tour operator (membership number V2185). Airport parking
and related services are provided through BCP Limited. For the purposes
of these terms and conditions Holiday Autos Limited, Hertz Europe Limited,
Holiday Express (UK) Limited, Bluebell Networks Limited (or any of
their tour operators), Cresta Holidays Limited and BCP Limited shall
be included in the term Travel Supplier.
Opodo does not assume any responsibility for the travel products
and services provided by the Travel Supplier and makes no representations
or warranties (express or implied) about the suitability or quality
of travel products and services featured on the Site.
Opodo is not responsible for the costs of any transfers between airports
or terminals that you may incur.
Information on the Site
Opodo offers all of the general information on the Site for purposes
of guidance only. Please note that the published information may change
at any time. You need to check with the relevant Travel Supplier, destination,
embassy, or tourist office to confirm the guidance is up to date. In
particular, with respect to passports, visas, and vaccination requirements,
Opodo does not guarantee that the information is always up to date
and it is your responsibility to ensure that you understand and comply
with all relevant passport, visa, and vaccination requirements.
Opodo does not guarantee that information on the Site (including
without limitation prices, descriptions or dates) is free from errors
or omissions but we will use all reasonable endeavours to correct any
errors or omissions as soon as practicable once they have been brought
to our attention.
Travel Supplier Conditions
Any booking you make on the Site shall be deemed an offer by you
to purchase your chosen travel product or service from the Travel Supplier.
If your offer is accepted you will receive a confirmation e-mail from
the Travel Supplier (or in the case of insurance or flights, from Opodo)
and a contract is established. All travel products and services featured
on the Site are subject to availability. The Travel Supplier's terms
and conditions (including airlines' terms and conditions of carriage)
will apply in addition to those set out here. The Travel Supplier's
terms and conditions may include provisions relating to payment procedures,
default, liability, cancellations, changes of bookings and refunds
(if available) and any other restrictions. Some airlines may charge
a supplemental transit-without-visa fee. As you move through the Site
you will see links to terms applying to specific offers (you are advised
to read those terms carefully) but please refer to your particular
Travel Supplier for full details as to the applicable terms and conditions.
As part of the booking process for flight tickets you are given the
option to enter the details of any relevant frequent flyer programme
of which you are a member. Please note that any such frequent flyer
programme is subject to the terms and conditions of the airline through
which it is offered. Those terms and conditions may not give rewards
on all types of fare and class of service. Please contact the airline
in charge of your frequent flyer programme if you are unsure of its
terms and conditions. You are responsible for complying with any airline
or other Travel Supplier conditions in relation to check-in times,
reconfirmation of flights, or other matters. Please note that, in relation
to flight tickets, the recommended minimum check-in time is 120 minutes
prior to departure for international flights and 90 minutes for domestic
flights. Some airlines require you to reconfirm your flight booking
at least 72 hours before travel. Failure to reconfirm your flight booking
directly with the airline may result in cancellation. You are also
required to use all flight coupons in order of sequence. If this requirement
is not met the airline may void the ticket. Special offer fares from
KLM include online discounts.
E-Tickets
Please note that airlines have their own rules and regulations with
regard to e-ticketing. Lufthansa, for example, requires that you have
your credit or Miles & More card with you when you check-in, and
that you comply with their check-in deadlines. Opodo cannot be held
responsible for non-compliance with these regulations and strongly
recommends that you check these details with your airline in advance
of travel.
Cancellation/Modification
Where the Travel Supplier allows you to cancel or modify a travel
product or service that you have already booked or purchased, it is
your responsibility to notify the Travel Supplier (or in the case of
flights or insurance, Opodo) in writing of such request. For flight
bookings, it is also possible to cancel or modify your booking by telephoning
the Opodo call centre on 0870 241 7051. It may not be possible to cancel
or modify some products or services or there may be specific requirements
you will have to meet. Opodo or the Travel Supplier accepts all forms
of written requests. Opodo or the Travel Supplier is unable to cancel
or modify a travel product or service prior to receipt of your request.
For hotel bookings it is possible to cancel or modify your booking
through the Site in accordance with the hotel's specific terms and
conditions.
In the event that you make any alteration to your flight booking
(including, but not limited to, cancellations, refunds, amendments
and name changes), Opodo reserves the right to charge you an administration
fee of 10GBP per ticket to cover the administration costs incurred
by Opodo. These charges do not include any charges imposed directly
by the airline.
Payment
Full payment for all air and insurance products is required at the
time of booking. Payment methods other than those stated on the Site
will not be accepted and no responsibility is accepted for cash sent
through the post. Opodo will pass your credit card details to the Travel
Suppliers, who will take payment for your hotel bookings in accordance
with the relevant hotels' terms and conditions. The relevant Travel
Supplier will take payment for bookings other than flights and insurance
(Holiday Autos Limited or Hertz Europe Limited for car rental, Holiday
Express (UK) Limited for package holidays, Bluebell Networks Limited
for specialist holidays, Cresta Holidays Limited for city breaks and
BCP Limited for airport parking and related services).
Before payment is received in full, Opodo or the Travel Supplier
is not obliged to issue any tickets, confirmations, vouchers, or other
travel documents. However, you shall in all cases remain liable for
payment of the amounts agreed for the travel products and services
ordered. Opodo is an IATA Ticketing Agent - your tickets for scheduled
flights will be sent to you within 24 hours of payment being accepted.
Payment can be made by all major debit and credit cards as detailed
on the Site. Payment can be made to Travel Suppliers by all major debit
and credit cards. Opodo reserves the right to charge you in addition
for any handling fees we or the Travel Supplier incur in relation to
bookings made by credit card. You will be notified of the relevant
charges, if applicable. Opodo reserves the right to pass on any charges
relating to card charge backs. If your booking is being paid for with
a third party credit card we may require written authorisation to be
provided by the card-holder.
Opodo or the Travel Supplier reserves the right only to deliver tickets,
confirmations, vouchers or other travel documents to your credit card
billing address when requested to do so by the credit card issuer.
Failure to supply the correct credit or debit card billing address
information may result in delays to the issue of your tickets and may
make the fare(s) subject to increase. Please ensure that the billing
address details you give match those on your billing statement.
Further, in an effort to minimise the effects of credit card fraud,
we reserve the right to carry out random checks, including checks of
the electoral roll, and may request you to either fax or post to us
proof of your address and a copy of the credit card and recent statement
before issuing any tickets.
Taxes fluctuate in line with exchange rates.
Use of the Site
The Site is provided on an 'as is' and 'as available' basis. Opodo
does not accept any liability in respect of your ability to access
or use the site at any time or any interruption in that access or use
or any failure to complete any transaction. Opodo does not warrant
that the Site is free from computer viruses or other properties that
may cause loss or damage.
User Obligations
You agree to be bound by the following obligations, including without
limitation:
You accept financial responsibility for all transactions made under
your name or account.
You must be 18 years of age or over and have legal capacity.
You warrant that all information you provide about yourself or members
of your household shall be true and accurate.
The Site must not be used for speculative, false or fraudulent bookings.
The transmission of threatening, defamatory, pornographic, political,
or racist material or any material that is otherwise unlawful is expressly
prohibited.
The Site and any content may not be modified, copied, transmitted,
distributed, sold, displayed, licensed or reproduced in any way by
you, except that one copy of the information contained within the Site
may be made for personal, non-commercial use.
Newsletter
You may choose to complete a subscription to Opodo's newsletter,
which will be sent to your email address and will include news, information
and offers.
Denial of Access
Opodo reserves the right to deny access to the Site at any time without
notice.
Liability of Opodo
Opodo will not be liable for any indirect or consequential loss of
any kind in contract, tort or otherwise arising out of your use of
this Site or any of the travel products or services booked or purchased
on the site.Where Opodo is liable for direct loss this will be limited
to a maximum of the total price of the products or services in respect
of which a claim is made (save for the case of death or personal injury
in respect of which there is no limit).
Links to Third Party Web Sites
The Site may contain hyper links to external web sites owned and
operated by third parties. Opodo has no control over or association
with such third party sites and no responsibility in relation to the
accuracy, completeness and quality of the information contained within
them. Any and all contents on these external web sites do not reflect
products, services or information provided by Opodo. You should direct
any concerns regarding any external link to the site administrator
or webmaster of such site.
Force Majeure
Opodo shall not be liable for any failure in the course of this Agreement
if the same shall arise out of a force majeure event. This shall include
without limitation government intervention, wars, civil commotion,
hijacking, fire, flood, accident, storm, strikes, lockouts, terrorist
attacks, or industrial action affecting Opodo or its suppliers.
Currency Converter
Currency rates quoted in the Site are derived from a number of sources
and may not in all cases be updated daily. You may wish to verify actual
rates on the date of booking.
Changes to the Site
Opodo may change any aspect of the Site or its content, including
the availability of any suppliers, features, information, database
or content.
Copyright and Trademarks
The copyright and all proprietary rights in the Site and all content
are reserved by Opodo. The material contained within the Site is the
property of Opodo or its affiliates unless identified as belonging
to third parties. The name Opodo and any other marks, logos and graphics
of Opodo displayed on the Site are registered trademarks of Opodo or
its affiliates. Other company and product or service names displayed
on the Site may be the trademarks of their respective owners.
You are not granted any right or licence to use any trademarks.
Privacy Policy
The terms of the Opodo Privacy Policy are incorporated into these
Terms and Conditions. You agree to the use of personal information
by Opodo and its affiliates or third party suppliers in accordance
with the terms of and for the purposes set forth in the Opodo Privacy
Policy.
Evouchers
If you have used an e-voucher when making a booking on the Site,
you agree that you have read and accept the e-voucher terms and conditions.
Security Policy
Opodo uses secure technology in order to safeguard personal information
and financial transactions. Opodo complies with the procedures and
security standards as further set out in the Opodo Security Policy.
Changes to Terms and Conditions
Opodo reserves the right to change or update the Terms and Conditions
relating to use of the Site from time to time without prior notice
to Users. The current version of the Terms and Conditions will be displayed
within the Site from the date on which any changes come into effect.
Continued use of the Site following any changes to the Terms and Conditions
shall constitute your acceptance of such changes.
Governing Law
This User Agreement is between you and Opodo and is governed by the
laws of England and Wales.
